Who Owns Mineral Rights to My Property?

Think you have rights to whatever is on your property?

THINK AGAIN!

While it seems like common sense that one should be able to do whatever one wants with their own property – that’s not the case for most homeowners.

who owns mineral rights to my property

Looking to do any of these things to your property?

  • add or remove walls
  • change the use of a room (such as by converting a garage to a living room)
  • change the piping in your house
  • re-roof your house, or
  • demolish a portion of your house.
  • New windows: Replacing an existing window doesn’t usually require a permit, but cutting a hole for a new window generally does. This includes skylights and new doors.
  • Plumbing and electrical: A permit is probably required if you’re installing new or removing existing plumbing. Any job that includes installing a new electrical service to your home also requires a permit. Even something as simple as moving an outlet requires a permit.
  • Siding: Most municipalities require a permit for siding projects.
  • Water heater: You need a permit to replace your water heater. You may also need a permit for ventilation system changes.
  • Total cost: Some municipalities even require a permit if renovations or construction projects cost more than a certain amount— usually $5,000 or more.

Guess what, if you don’t have a land patent – you’re going to need a permit.

Pretty crazy, isn’t it? After all, why would you need to ask for permission to do anything to the property if you TRULY OWNED ITright?

Just more proof that you don’t actually own your property (yet!)

In addition to obtaining a building permit, depending on the scope of your project, you might need to obtain special system permits, such as electrical, plumbing, or mechanical permits.

For example,
you might need to obtain a plumbing permit if you plan to install an underground lawn sprinkler. Or, you may need a mechanical permit to install a central air conditioning unit.

What If I Skip Getting a Permit?

The city might force you to obtain a permit and could double or triple the permitting fees. It may also shut down your project or require you to tear down your work (for example, remove a wall to see what’s behind it) if there is a question as to whether the work was done according to code.

The worst thing would be if this were to happen when you’re in the middle of trying to sell your house, which is when such issues often come to light. Unpermitted construction can lower your home’s value, and you might even need to bring it up to code as a condition of the sale.
