What is Allodial Title?

Allodial title is when real property (i.e. land, buildings, and fixtures) is owned free and clear of any superior landlord and not subject to feudal obligation or the restrictions of fee simple ownership.

A Brief History of Allodial Title

You know how when you own a piece of land, you’re usually expected to do certain things for the person or government that gave you that land? Well, that’s called “feudal tenure.” It means you have to provide services, like serving in the military or paying taxes, in exchange for owning the land.

But there’s another way to own land called “allodium.” This means you own the land free and clear and have complete freedom with your land. You don’t owe any services or taxes to anyone. It’s all yours, no strings attached.

In the old days, during the Middle Ages, almost everyone had land with strings attached – the feudal kind. Allodium land was pretty rare back then because most land had obligations tied to it.

Around the end of the 9th century in France, there was a bit of chaos when the Carolingian monarchy started falling apart. During this time, more land started to become allodial. People had land that was truly theirs, without having to serve anyone else.

But this freedom didn’t last long because a lot of that new allodial land eventually became part of the feudal system again.

In the feudal system, landowners had to do stuff for their (land) lords, like fight in wars or help with legal matters. So, even if they technically owned the land, they weren’t totally in charge.

Over time, in France, the whole feudal thing started to fade away. Then, after the French Revolution in 1789, pretty much all land in France became allodial. That means people finally had land that was truly, completely theirs.

In England, there was some allodial land before 1066, but after the Norman Conquest, that kind of ownership disappeared. The Normans brought their own rules, and people had to follow the feudal system. To own land, you had to prove you had a special permission slip from the king or some other important person.

But by the late 1700s in Great Britain, things started changing. Feudalism was on its way out, and they adopted a system called “fee simple ownership.” This is a bit like allodium – it means you have full control over your land, with no obligations to anyone. Except they also started keeping records of who owned what land (land registries) and taxing property.

When the United States was just a group of colonies, they followed the British way of doing things. All land could be traced back to some piece of paper from a king or the government. But after the Revolutionary War, when the U.S. became its own country, all that old ownership tied to the king went away. Land became fee simple, just like in Great Britain.

As the U.S. expanded, the government became the owner of newly acquired land. Then, they gave that land to private individuals or groups through special documents called “land grants” or “land patents.”

Allodial Title vs. Fee Simple Ownership

So, in a nutshell, today, most private land ownership in the United States goes back to a government grant. It’s not really allodium, but it’s a lot like it because you have control over your land without owing services to anyone else.

When you buy a house today, that’s called “fee simple ownership.”

It’s like having full control over a piece of land and any buildings on it like sheds or garages. When you have fee simple ownership, it means you can pretty much do whatever you want with your property, as long as you pay property taxes, follow local rules about things like what you can build or how you can use the land. You can add things, build new buildings, or even sell it whenever you feel like it. It’s your property to do with as you please.

In the United States, fee simple ownership is the most common and highest form of property ownership. However, there’s a catch…

If you don’t pay your property taxes or meet certain obligations, the government or other folks can put a claim or lien on your property. They might even take it away through a process called foreclosure.

That’s where “allodial title” or a “perfected land patent” comes in. It’s like taking back full and true ownership of your property. With allodial title, you have even more freedom because it means your property rights aren’t tied to any government or person. You’re the boss of your land, and nobody can mess with it.

Summa Corp. v. Cal. State Lands Comm’n, 466 U.S. 198 (1984) established that ownership through a land patent cannot be superseded by the State or anyone else.

So while the elite continue to barrel toward Agenda 2030, we can beat them at their game by utilizing the same tools that they use.

Perhaps the greatest of those tools (aside from learning the legal avenue to avoiding taxable events) is obtaining an allodial title through a land patent.

Without allodial title, there is always the potential to lose ownership of your property (even once your property is 100% “paid off”).

The land patent confirms that your property is no longer subject to any third-party challenge through the complete privatization of your land.

The land patent is the only form of proof of absolute title to landIt protects the freeholder from any claims of co-ownership as well as the U.S. government.
